PRIVACY POLICY

When you use websites, products, services, or other activities (“Services”) provided by BOOKOFF U.S.A. INC. and all of its subsidiaries, we collect and handle information as described below. Your use of our Services constitutes your consent to these practices. This policy is intended to comply with the California Consumer Privacy Act of 2018 (the “CCPA”), as amended by the California Privacy Rights Act of 2020 (the “CPRA”). Although the CCPA is applicable only to California residents, this policy applies to all consumers of our Services.

    Sensitive Personal Information  Personal information revealing a consumer’s social security number, driver’s license and passport numbers, account numbers and credentials, precise geolocation, racial or ethnic origin, religious beliefs, or union membership, personal information concerning a consumer’s health, sex life, or sexual orientation, contents of a consumer’s mail, email and text messages where the business is not the intended recipient, genetic data, biometric information, and citizenship or immigration status. 
    Biometric Information  An individual’s physiological, biological, or behavioral characteristics, including information about an individual’s deoxyribonucleic acid (DNA), that is used or is intended to be used singly or with each other or with other identifying data, to establish individual identity. Biometric information includes, but is not limited to, imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings, from which an identifier template, such as a faceprint, a minutiae template, or a voiceprint, can be extracted, and keystroke patterns or rhythms, gait patterns or rhythms, and sleep, health, or exercise data that contain identifying information. 
    Geolocation Data  Any data that is derived from a device, and that is used or intend ed to be used to locate a consumer within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet, except as may be otherwise prescribed by regulations.  
    Legitimate Interest  When we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interest. 
  2. Personal Information We Collect About You. In the preceding twelve (12) months, we have collected the following categories and specific types of consumer personal information:

    • Mailing Address; 
    • Home Address; 
    • Government identification, including, but not limited to passport numbers, driver’s license or state identification card (only as it to our employees and job applicants); 
    • Credit cards (for payment processing); 
    • Debit cards (for payment processing); 
    • Shop Pay Account (for payment processing); 
    • Google Pay Account (for payment processing). 
    Characteristics of protected classifications under California or federal law (e.g., age, ancestry, color, disability, ethnicity, gender, gender identity or expression, genetic information, medical conditions, military status, national origin, pregnancy, race, religion, sex, sexual orientation, veteran status, or any other bases under law). 
    • Age (only as it relates to our employees and job applicants); 
    • Ethnicity (only as it relates to our employees and job applicants); 
    • National origin (only as it relates to our employees and job applicants); 
    • Race (only as it relates to our employees and job applicants); 
    • Sex (only as it relates to our employees and job applicants). 
    Commercial information (e.g., records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies) 
    • Purchase history; 
    • Favorited products; 
    • Viewed products. 
    Biometric Information 
    • Fingerprints (only as it relates to our employees and job applicants). 
    Internet or other electronic network activity information (e.g., browsing history, search history, and information regarding a consumer’s interaction with an Internet Website, application, or advertisement) 
    • Our third party service provider, Google, may collect certain analytics data from you, which includes, but is not limited to, number of users, session statistics, and browser and device information. For additional information, please see Section 5 – Who We Share Your Personal Information With. 
    Geolocation Data 
    • Our third party service provider, Google, may collect certain analytics data from you based on the use of our Services, which includes, among other information, your Geolocation Data. For additional information, please see Section 5 – Who We Share Your Personal Information With. 
    Audio, electronic, visual, thermal, olfactory, or similar information 
    • We have not collected audio, electronic, visual, thermal, olfactory, or other similar information in the preceding twelve (12) months. 
    Professional or employment-related information 
    • Prior employment history (only applicable to our job applicants); 
    • Employment as a teacher; 
    • Employment as a librarian. 
    Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (FERPA) 
    • Education background and history (only applicable to our job applicants) 
    Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes 
    • We have not drawn inferences from any of the above collected information identified above to create a profile about consumers, or consumer preferences, characteristics, psychological trends, predispositions, behaviors, attitudes, intelligence, abilities, or aptitudes in the preceding twelve (12) months. 
    Sensitive Personal Information

  3. How your Personal Information is Collected. We collect most personal information directly form you (i.e., in person, by telephone, via text or email, or through our website). However, we may also collect information from the following categories of sources: 
    • Publicly accessible sources (e.g., property records);
    • Third parties (e.g., sanctions screening providers, credit reporting agencies, customer due diligence providers, advertising networks, internet service providers, social networks, data analytics providers, government entities, and data brokers) 
    • Third parties with your consent (e.g., e-commerce platforms, banks); 
    • Cookies on our website; 
    • Automated information collection. 
  4. Why We Use Your Personal Information. We collect, and share consumer personal information for the following business purposes: 
    • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards;
    • Helping to ensure security and integrity to the extent the use of the consumer’s personal information is reasonably necessary and proportionate for these purposes;  
    • Debugging to identify and repair errors that impair existing intended functionality;
    • Short-term, transient use, including, but not limited to, non-personalized advertising shown as part of a consumer’s current interaction with the business, provided the consumer’s personal information is not disclosed to another third party and is not used to build a profile about the consumer or otherwise alter the consumer’s experience outside the current interaction with the business;
    • Performing services on behalf of the business, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services on behalf of the business or service provider;
    • Providing advertising and marketing services, except for cross-context behavioral advertising, to the consumer;
    • Undertaking internal research for technological development and demonstration;
    • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by the business;
    • To comply with our legal and regulatory obligations;
    • For the performance of our contract with you or to take steps at your request before entering into a contract;
    • For our Legitimate Interests or those of a third party; or
    • Where you have given consent.

    Below, we highlight what we use (process) your Personal Information for, and our reasons for doing so:

  5. Who We Share Your Personal Information With. In the preceding twelve (12) months, we have sold or shared consumers’ personal information with: 
    • Google Analytics. Google Analytics is a third-party analytics service provided by Google that monitors, tracks, and reports traffic on our website. The collected data is used by Google to monitor and track how you use our Services. This data may be shared with other Google services. Google may use the collected data to contextualize and personalize ads on its own advertising network.       If you wish to opt-out of having your activity on our site available to Google and Google Analytics, you can install the Google Analytics opt-out browser add-on. This add-on will prevent Google Analytics’ JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google and Google Analytics about your website activity.     • G-Pay. At checkout, we provide you the option to make a payment via the G-Pay, a payment processing application by Google. The collected data is used by Google to process payments on our behalf. Google may use the collected data for additional purposes.     • Shopify. Our online store is powered by Shopify, a third-party service provider that provide e-commerce support. Among other services, Shopify assists us in the tracking and placement of orders from our customers, and manages and processing payments made by you for our products. Shopify collects data to track your purchase history, and allow us to customize the services we provide to you on our online shop. Shopify also collected certain payment information on our behalf to process your payments for our products.     • Shop Pay. At checkout, we provide you the option to make a payment via Shop Pay, a payment processing application by Shopify. The collected data is used by Shopify to process payments on our behalf. Shopify may use the collected data for additional purposes.     We only allow service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers, contractors, and third parties to ensure that they can only use your personal information to provide services to us and to you. 

     We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations. 

     We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or as a result of re-structuring. We will typically anonymize personal information, but this may not always be possible. The recipient of the information will be bound by non-disclosure and confidentiality obligations.

    • Keep records required by law. 

    We will not retain your personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information.

    • Re-identify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered Personal Information; or, 
    • Provide the personal information to you more than twice in a 12-month period. 
    Disclosure of Personal Information Sold, Shared, or Disclosed for a Business Purpose  In connection with any Personal Information we may sell, share, or disclose to a third party for a business purpose, you have the right to know:

    Right to Deletion  Subject to certain exceptions as set forth below, on receipt of a verifiable request from you, we will:

    • Direct third parties to whom the business has sold or shared your Personal Information to delete such information unless this provides impossible or involves disproportionate effort. 

    Please note that we may not delete your Personal Information if it is reasonably necessary to:

    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; 
    • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 
    • Comply with an existing legal obligation; or, 
    • Otherwise use your personal information internally, in a lawful manner that is compatible with the context in which you provided the information. 
    Right of Correction  If we maintain inaccurate Personal Information about you, you have the right to request us to correct that inaccurate Personal Information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate Personal Information. 
    Protection Against Retaliation or Discrimination  You have the right not to be retaliated against by us because you exercised any of your rights under the CCPA/CPRA. This means we cannot, among other things: 
    • Deny goods or services to you; 
    • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; 
    • Provide a different level or quality of goods or services to you; or, 
    • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services. 

    Please note that we may charge a different price or rate or provide a different level of quality of goods and/or services to you, if that difference is reasonably related to the value provided to our business by your Personal Information. We may also offer loyalty, rewards, premium features, discounts, or club card programs as compensation, for the collection of Personal Information, the sale of Personal Information, or the retention of Personal Information.

  11. Children Under the Age of Majority. Our Services, including our website, are not intended for minors. No one under the age of majority may provide any Personal Information to or on our website. We do not knowingly collect the Personal Information of minors. If you are a minor, do not use or provide any information on our website on or through any of its features and/or links. If we believe we have collected or received Personal Information from a minor, we will delete that information. If you believe we might have been provided any Personal Information from or about a minor, you may contact us through the methods provided below.

  12. Do Not Track. Please note that our system may not recognize certain ‘Do Not Track’ signals or requests from some browsers. Third parties have content embedded on our websites, such as a social feature or a stock ticker, which may set cookies on a consumer’s browser and/or obtain information about the fact that a web browser visited a specific BOOKOFF USA website from a certain IP address. Third parties cannot collect any other personally identifiable information from BOOKOFF USA’s website unless you provide such information directly.

    keep_alive The keep_alive cookie is used to maintain a user’s session active on a website, preventing automatic logout during periods of inactivity. 
    _identity_session Contains the identity session identifier of the user.  
    checkout Used in connection with checkout.

    Performance Cookies  _ga_R9YJGPFM0P This cookie is used by Google Analytics to persist session state. 
    _ga This Google Analytics cookie is used to distinguish unique users by assigning a randomly generated number as a client identifier. It is included in each page request in a site and used to calculate visitor, session and campaign data for the site’s analytics reports. 
    _gid This cookie is set by Google Analytics. It stores and update a unique value for each page visited and is used to count and track pageviews. 
    Functionality Cookies  localization These cookies are set on pages with the Flickr widget. 
    _ssw_cart_data This cookie is used to store information about the user’s shopping cart contents and interactions to enhance the shopping experience. 
    _ZB_STATS_VISIT This cookie is used for Zotabox tool tracking (impression, click, submission, email sign ups.)
